Jarvànt Skincare Terms of Use

These General Terms and Conditions regulate the relations between the Supplier and the Users (Clients) who use the online store jarvantskincare.com for purchasing goods. By clicking on an object, image, link (other than that of the General Terms and Conditions) or button located on the jarvantskincare.com website, you are deemed to accept and agree to the General Terms and Conditions described below. These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA) as well as other regulations in force in the Republic of Bulgaria.

DEFINITIONS:

"SUPPLIER" is the website jarvantskincare.com, owned by "Grand Millennium" Ltd., with headquarters in Bulgaria, Plovdiv, postcode 4003, "Slivnitsa" Str. 2a, UIC 206810899, and serves as a virtual platform for the sale of goods. The Supplier is the person with whom the User enters into a distance sales contract for a specific item (product) in the online store.
"USER" is a legally competent person who has agreed to these General Terms and Conditions in connection with ordering and purchasing goods offered in the online store.
"ONLINE STORE" is the website jarvantskincare.com, which serves as a virtual platform for offering goods for sale and for reaching an agreement between the SUPPLIER and the USER for the order and purchase-sale of a specific item (product).
The Supplier, who creates and maintains the online store, offers and sells the goods in the store, and determines these General Terms and Conditions under which the goods are sold. The Supplier has full rights to unilaterally change the content of the Website, as well as the methods of access to it.
"ORDER" is the User's request to the online store for the purchase of one or more specific goods (items). The order is packaged and sent by courier to an address previously specified by the User in the order, after it has been approved by email or phone. Email approval is done by sending a confirmation email. Phone approval is done after a call from an online store employee for confirmation.
"SALE CONTRACT" is the contract for the sale of goods between the Supplier and the User, concluded remotely through this online store.
"COURIER" is a merchant who physically delivers the purchased goods to an address specified by the User and operates in accordance with the requirements of the Postal Services Act.
"BROCHURE/ADVERTISEMENT" refers to electronic informational messages concerning goods sold in the online store during a specific period of time, which may be placed on the website or sent by email to the User.

REGARDING THE CONFIDENTIALITY OF USER DATA:

Jarvantskincare.com processes and takes measures to protect the personal data of users in accordance with the requirements of the Personal Data Protection Act. Users agree that jarvantskincare.com has the right to process their personal data in connection with the use of the website's services. To service and fulfill User orders, jarvantskincare.com requires acceptance of the following data:
– first and last name;
– email;
– contact phone;
– billing and delivery address;
– postal code;
– Internet Protocol (IP).
Subsequently, the User has the option to correct this data from their personal profile, if one has been created. If the User places an order as an Unregistered User, the data in it can be corrected by calling jarvantskincare.com consultants if necessary.
The data that jarvantskincare.com receives during an order, registration, or browsing pages will be used solely for servicing the User – accepting and fulfilling orders, subscribing to news, contacting the User regarding order-related issues, and improving the online store service.
Jarvantskincare.com guarantees that this data will not be provided in any form to third parties or used for purposes other than those described above.
Users subscribed to news can unsubscribe at any time using the link at the end of each news item.
A user account can be deleted from the jarvantskincare.com system, along with the attached data, upon the User's request.

TERMS OF USE OF THE ONLINE STORE:

1. Browsing the online store jarvantskincare.com is completely free and accessible;
2. Registration of a user account on jarvantskincare.com is NOT mandatory – the client can use the site, place orders, or ask questions through the provided contact form without creating a personal account on the site;
3. By creating a registration on the jarvantskincare.com site, account details can be corrected at any time from the "Personal Profile" section. If the correction applies only to a specific order, this can be done in the final stage of the order.
After registration, the User receives a username and password, and jarvantskincare.com recommends maintaining their confidentiality. It is advisable not to provide the password and username to third parties, and in case of suspected misuse, immediately report to jarvantskincare.com;
4. In the online store jarvantskincare.com, the price of each product, the main characteristics of the product, and additional information aiming to help with an informed choice when purchasing the product are indicated. Also, on each presented product page, users of jarvantskincare.com have the opportunity to provide opinions and ratings regarding the product;
5. All prices indicated on the site are final, including VAT.

ORDERING GOODS:

1. To place an order in the online store, the User must provide the following data:
1.1. Valid email address;
1.2. Correctly filled delivery address for the goods and billing address;
1.3. Correctly filled contact details – two names, phone number.
2. Upon a successfully placed order, the User receives an order confirmation by email to the email address provided. The email confirmation indicates the ordered goods, the order number, and the date and time of placing the order. Telephone confirmation is made only if additional information or clarification regarding the order is needed;
3. If the ordered goods are not available, the consultant will notify the User by email or phone. If the User does not agree to have the order redirected to another product or to have the unavailable product sent at a later stage, the order can be canceled;
4. Orders in the online store jarvantskincare.com are accepted 24 hours a day, 7 days a week;
5. Orders placed on weekends, public holidays, or after 12 o'clock are processed on the next working day.
6. The working hours of the consultants of the online store jarvantskincare.com are:
09:00-17:30 from Monday to Friday;
7. Orders received without correct buyer (User) details or with missing data are canceled;

DELIVERY OF ORDERED GOODS:

1. After receiving an order from a User on jarvantskincare.com, the online store's automated system notifies the User by email of the successfully accepted order;
2. Once the order is handed over to the Courier for delivery, the User receives an email confirming that the goods have been dispatched;
3. Delivery is made to an address precisely specified by the User (whether it is a residential, office, or courier company office address);
4. If the User does not provide access and conditions for the delivery of the goods to the specified address within the specified period, the Seller is released from the obligation to fulfill the requested delivery.
5. Deliveries within the EU are carried out by the respective courier company for each country to which the shipment travels.
6. Orders placed during promotional campaigns, pre-holiday and holiday periods are processed within 3 working days and delivered according to the courier company's workload.

Delivery prices:

For any order over 160 BGN, delivery is free.
Deliveries within Bulgaria are carried out by "Econt" courier company, and the prices are as follows:
– For delivery to an Econt/Speedy office – 6.00 BGN;
– For delivery to an address specified by the User – 7.00 BGN.
– For delivery with Box Now – 2.50 BGN.

Deliveries to EU countries are determined depending on the region in which the respective country is located, as follows:

PAYMENT:

1. Payment for an order placed by the User can be made through a secure electronic payment system with a debit or credit card issued by Visa, Mastercard, American Express, Discover & Diners Club, China UnionPay, Japan Credit Bureau (JCB), Cartes Bancaires and eftpos.
2. For each ordered product, the User pays the price advertised in the online store at the time of the order. The price of each product can change dynamically;
3. The User has the right to receive an invoice for the value of their order. To do this, it is necessary to provide all the required details of the physical or legal person for issuing an invoice, and to indicate in the "Notes" field of the order that they wish to have one issued.
An invoice can be issued no later than 5 days from the date of the order.

ORDER CANCELLATION AND RETURNS:

The User can return products purchased from jarvantskincare.com within 14 days from the date of purchase under the following conditions:
– Products must be in their original packaging;
– There should be no signs of use, broken packaging, or stains;
– Must include the original invoice and/or all accompanying documents with which the User received the products;
– The costs of returning the products are at the User's expense.
Products can be exchanged for others or refunds issued if the user does not wish to exchange them. In the aforementioned case, jarvantskincare.com will refund the value of the products, excluding shipping costs.
All amounts paid with a debit/credit card are refunded to the same account (card) from which the payment was made, within 14 days from the date the User returned the order.

CONDITIONS FOR COPYING INFORMATION:

1. The trademark rights, intellectual property, and copyrights, and all information published on the jarvantskincare.com website, are owned by "Grand Millennium" Ltd. The online store allows other owners and users of the website to publish links to the online store jarvantskincare.com;
2. Copying texts from jarvantskincare.com and placing them on other websites and online stores is prohibited without the written consent of "Grand Millennium" Ltd. or without reference to the source.

LIABILITY

The supplier of the goods is responsible for defects in the goods, for the performance of the distance sales contract, as well as for the refund of paid amounts;
"Grand Millennium" Ltd. bears no responsibility to third parties if they believe that information published in the online store violates someone's copyright or other intellectual property rights.

BROCHURES AND NOTICES:

1. When the User registers in the online store by creating a Profile on the Website, accepting the General Terms and Conditions, they agree to receive brochures and/or messages from "Grand Millennium" Ltd., as well as messages regarding product orders and confirmations of changes to their data;
2. The User can unsubscribe from receiving brochures and/or email notifications at any time by sending an email to jarvant@jarvantskincare.com with an explicit request not to receive brochures and/or notifications;
3. "Grand Millennium" Ltd. reserves the right to choose to whom to send brochures and/or notifications, as well as to remove from its database a User who has given consent to receive brochures and/or notifications;
4. "Grand Millennium" Ltd. includes in brochures and/or announcements only advertising information related to the goods sold in the store.

2. "Grand Millennium" Ltd. is the administrator of the website and consequently of the comments and discussion section, and in fulfilling this function, can remove any uncensored and offensive qualifications that violate morals and good manners.

DISPUTES. ALTERNATIVE DISPUTE RESOLUTION:
The supervisory authority for consumer rights protection in Bulgaria is the Commission for Consumer Protection with address: Sofia 1000, 4A Slaveykov Square, 3rd, 4th, and 6th floors; tel.: (02) 980 25 24; fax: (02) 988 42 18; hotline: 0879881572; website: www.kzp.bg.
In disputes regarding obligations arising from online sales contracts, when no agreement has been reached, the User may refer the dispute to the bodies for alternative resolution of consumer disputes (ADR) under the terms and procedures of Art. 181a and subsequent articles of the Civil Code.
Additional information regarding alternative consumer dispute resolution is provided on the website of the Commission for Consumer Protection at https://kzp.bg and on the online dispute resolution platform ORS.

These General Terms and Conditions have been adopted by the manager of "Grand Millennium" Ltd., and the last amendment to them is as of 01.07.2023.
